Contracts
Contracts I and II will cover such basic tenets as formation of contracts, elements of contracts, quasi-contracts, issues and problems regarding contracts such as the Statute of Frauds, Parol Evidence, Mistake, Reliance and the like. There will be discussions on the construction of contracts (express and implied), constructive conditions, failure of performance, as well as the rights of third parties, breach of contract and remedies therefore, damages arising from the breach, curing of default and a host of other issues, time permitting.
Property
Property I and II will cover the traditional divisions between real and personal properties, as well as unique ways of dealing with the sale and leasing of each category of property. We will define and discuss warranties and guarantees, transfers of title, encumbrances, restrictive covenants and conditions, easements, various forms of deeds and their significance, deeds of trust, pledges, conveyancing, escrow, trustee, the various forms of joint ownership and the significance thereof, and a plethora of other related and significant issues.
Torts
Torts I and II will deal with one of the basic concepts of common law, the law of torts (an area yet in its initial stages in Hungary, but gaining in significance). Torts are civil wrongs outside of a contractual relationship. Violation of an obligation within the law of torts will result in money damages, compensatory and sometimes punitive as well. (Torts must be distinguished from criminal wrongdoing.) Torts can be intentional or non-intentional. Non-intentional torts are generally in the category of acts or omissions caused by negligence or recklessness. Torts also include defamation of character, libel and slander, civil assault and battery, and many other civil wrongs, for example: tortious interference with a contract and all forms of malpractice (medical, legal, accountancy, architecture, etc.).
